Terms of Service

By accessing or using the SCT Suite platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

SCT provides a suite of trading tools and services, including but not limited to: - Signal Forwarding: Automated forwarding of trade signals across connected platforms and broker accounts. - Trade Journal: A comprehensive trade journaling platform for logging, reviewing, and analyzing your trading activity. - Funded Account Tracking: Tools for monitoring and managing funded trading account performance, milestones, and payout eligibility. - Broker Integration: Connectivity to supported brokers (Tradovate, MetaTrader 4/5) for automated trade synchronization. - Analytics & Reporting: Performance metrics, equity curves, drawdown analysis, and other statistical insights derived from your trading data. - Custom Indicators: Proprietary TradingView indicators provided as part of eligible subscription tiers.

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years of age to register. You agree to notify us immediately of any unauthorized use of your account. SCT is not liable for any loss arising from unauthorized access to your account.

SCT offers the following subscription tiers, each with varying levels of access: - Inner Circle: Includes access to the trade journal, signal forwarding, broker sync, and community features. - Flex: Includes all Inner Circle features plus additional analytics, custom indicators, and priority support. - Unlimited: Full access to all SCT features, including all indicators, unlimited broker connections, advanced analytics, and dedicated support. Specific features and pricing for each tier are detailed on our website and may be updated from time to time. Downgrading your tier may result in loss of access to certain features.

Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected). Payment is due at the beginning of each billing cycle. All fees are non-refundable. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account. All prices are listed in USD unless otherwise stated.

You agree not to: - Use the Service for any unlawful purpose or in violation of any applicable laws or regulations. - Attempt to reverse-engineer, decompile, or disassemble any part of the Service, including proprietary indicators and algorithms. - Redistribute, resell, or share your account access, indicators, or signal forwarding capabilities with unauthorized third parties. - Interfere with or disrupt the integrity or performance of the Service or its infrastructure. - Use automated bots, scrapers, or other tools to access the Service without our express written consent. - Misrepresent your identity or affiliation with any person or entity. - Upload or transmit any malicious code, viruses, or harmful content.

All content, software, indicators, strategies, algorithms, and materials provided through the Service are the exclusive intellectual property of SCT and its licensors. This includes, without limitation, proprietary TradingView indicators, trading strategies, signal logic, and platform code. You are granted a limited, non-exclusive, non-transferable license to use these materials solely for personal, non-commercial trading purposes during your active subscription. You may not copy, modify, distribute, sell, or create derivative works based on our intellectual property.

To the maximum extent permitted by law, SCT and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, trading losses, data loss, or other intangible losses, resulting from: - Your use of or inability to use the Service. - Any unauthorized access to or alteration of your data or transmissions. - Any third-party conduct on or related to the Service. - Signal forwarding delays, execution failures, or broker connectivity issues. Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SCT is NOT a registered investment advisor, broker-dealer, or financial planner. The tools, signals, indicators, and information provided through the Service are for educational and informational purposes only and do not constitute financial advice, investment advice, or trading recommendations. Trading futures, forex, and other financial instruments involves substantial risk of loss and is not suitable for all investors. Past performance of any trading system, methodology, indicator, or signal does not guarantee future results. You are solely responsible for your own trading decisions and any resulting profits or losses. You should consult with a qualified financial professional before making any investment decisions. SCT Suite provides software and education only. Not financial advice. Not account management. Trading involves substantial risk of loss. Past performance is not indicative of future results.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Provisions that by their nature should survive termination shall remain in effect.

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Wyoming. The arbitrator's decision shall be final and binding, and each party shall bear its own legal costs unless the arbitrator determines otherwise. You waive any right to participate in a class action lawsuit or class-wide arbitration against SCT. To the extent any dispute is not subject to arbitration, you agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Wyoming.

The Service may allow you to upload, submit, or transmit content such as journal notes, screenshots, images, videos, audio, and files ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant SCT a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and display that content solely for the purpose of operating and providing the Service to you. You represent and warrant that you own or have the necessary rights to all User Content you submit, and that your User Content does not infringe the intellectual property, privacy, or other rights of any third party. You may not upload content you do not have the right to use. SCT respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, send a written notice to our designated agent that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the allegedly infringing material and its location on the Service; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner. DMCA notices should be sent to: support@sctsuite.com (Attn: DMCA Designated Agent). We will remove or disable access to infringing material in accordance with the DMCA and will, in appropriate circumstances, terminate the accounts of users who are repeat infringers.
